Ingredients List Required on Diaper Packaging in New York State

New York State introduces law requiring all diapers to include a discernible and legible list of ingredients in order of predominance on outer packaging. Enforcement must start no later than 12 months after the effective date of the bill.

Effective December 11, 2024, New York Governor Kathy Hochul signed into effect Legislation S.2279C/A.43C. This law requires all diaper manufacturers to explicitly label the ingredients on all packages or boxes of diapers. The ingredients must be listed in order of predominance and can be either added directly on the label or affixed onto the packaging.

New research has suggested that the chemical composition of certain diapers can pose long-term risks to the health of infants, and this bill is intended to provide consumers with the right to know what they are putting onto their children’s bodies.

Within this bill, the terms ‘ingredient’ and ’diaper’ are defined as:

A summary of timeline in this act:

TimelineRequirement
From December 11, 2024No later than twelve months after the effective date of December 11, 2024, each package or box containing diapers sold in the state must contain a plain and conspicuous printed list of all ingredients in order of predominance. Such a list shall either be printed onto the package or affixed thereto
By December 11, 2025No manufacturers are allowed to sell diapers in the state of New York without an ingredient listing adhered to the packaging

If manufacturers fail to adhere to this new law, they will be liable to a civil penalty of one percent of their annual in-state sales, not exceeding one thousand dollars per diaper packaging.
